The plans specify that the existing garage is to <br />be removed, but did not specifically address the driveway. <br />The new garage to the south of the home would gain access via a privately improved <br />driveway that was built within the right of way of Mitchell Trail, and unimproved City <br />street right of way that was acquired in part from the subject property and adjoining lots, <br />and in part from a plat of the Mitchell property to the south. <br />Two issues came up at the Planning Commission that dominated discussion of this <br />item. <br />1. The retention of the existing driveway would leave the applicants with two "curb <br />cuts" — one to Twin Lake Road to the west, and one to Mitchell Trail to the south. <br />In the usual condition, single family homes may have just one curb cut on a <br />street, with a second curb cut allowed by Conditional Use Permit. However, the <br />CUP provisions would make this option difficult to meet. Those provisions <br />require, among other standards, that the street be of Minor Collector status, and <br />that the property has at least 100 feet of frontage. Neither of these conditions <br />exist for this site. <br />11 <br />
