MINUTES <br />CITY COUNCIL <br />JULY 25, 2012 <br />The Administrator suggested Option A with the driveway coming from the <br />north. Tim Mercil pointed out that this is a 3 -car garage, and they would <br />not have access to all three garage doors. Therefore, if the driveway <br />comes from the north, the garage must be realigned so that the garage <br />doors face west. <br />Aleks Klidzejs again suggested the driveway on the north with a five foot <br />setback from the north property line. <br />Montour asked the timing of the project. Mercil stated that if approval is <br />received tonight, he would start the project as soon as he gets an Xcel line <br />relocated. Mercil again stated that if he can place the garage as shown on <br />Option B, he was agreeable to utilizing the north driveway access. It was <br />noted that there would be no need for a license agreement under that <br />scenario as the north access exists under a private driveway easement. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by Keis, seconded by Boss, the public hearing was closed. <br />McGraw asked if the property owners to the west could contest this action <br />given there is a public easement /right -of -way on the south. The City <br />Administrator noted that the right -of -way is not improved. He also noted <br />that the private easement on the north is for ingress and egress for the <br />Mercil property and that easement is recorded. <br />Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2012 -7 -126 — APPROVING THE VARIANCE TO <br />ALLOW CONSTRUCTION OFA DETACHED GARAGE INA <br />FRONT YARD AND A VARIANCE FROM THE FRONT YARD <br />SETBACK REQUIREMENTS FOR 3246 TWIN LAKE ROAD AS <br />SHOWN UNDER OPTION B PRESENTED THIS EVENING <br />SUBJECT TO COMPLIANCE WITH THE PERTINENT <br />RECOMMENDATIONS OF THE CITY PLANNER AS OUTLINED IN <br />HIS REPORTS EXCEPT THAT THE DRIVEWAY ACCESS IS <br />REQUIRED TO COME FROM THE NORTH AND SUBJECT TO <br />THE FINDINGS OF FACT AS OUTLINED IN THE CITY <br />PLANNERS REPORT, AND SUBJECT TO THE EXISTING GARAGE <br />BEING DEMOLISHED NO LESS THAN 30 DAYS AFTER <br />COMPLETION OF THE NEW GARAGE <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (4) <br />Nays (1) McGraw.
