NOW, THEREFORE, in consideration of the premises and the mutual obligations <br />of the parties hereto, each of them does hereby covenant and agree with the other as <br />follows: <br />ARTICLE I <br />DEFINITIONS <br />Section 1.1. Definitions. All capitalized terms used and not otherwise defined <br />herein shall have the following meanings unless a different meaning clearly appears from <br />the context: <br />Agreement means this Agreement, as the same may be from time to time modified, <br />amended or supplemented; <br />Business Day means any day except a Saturday, Sunday or a legal holiday or a day <br />on which banking institutions in the City are authorized by law or executive order to <br />close; <br />City means the City of Little Canada, Minnesota; <br />City Costs means those costs and expenses described in Section 3.6 hereof; <br />County means Ramsey County, Minnesota; <br />Developer means R. J. Marco Construction, Inc., its successors and assigns; <br />Development District means the real property described in the Development <br />Program; <br />Development Program means the development program approved in connection <br />with the Development District; <br />Development Property means the real property described in Exhibit A; <br />Environmental Law means the Comprehensive Environmental Response, <br />Compensation and Liability Act, 42 U.S.C. Sec. 96.01 et seq., the Resource Conservation <br />and Recovery Act, 42 U.S.C. sec. 69.01 et seq., the Hazardous Materials Transportation <br />Act, 49 U.S.C. sec. 1802 et seq., the Toxic Substances Control Act, 15 U.S.C. sec. 2601 <br />et seq., the Federal Water Pollution Control Act, 33 U.S.C. sec. 1251 et seq., the Clean <br />Water Act, 33 U.S.C. sec. 1321 et seq., the Clean Air Act, 42 U.S.C. sec. 7401 et seq., the <br />Minnesota Environmental Response and Liability Act, Minn.
