Hanson <br />The Planning Commission has recommended a variance to allow construction of an 8 1/2 foot <br />high privacy fence for 72 Jessica Court owned by Mr. Terry Reeves. At the meeting with the <br />Planning Commission, Mr. Reeves indicated that his neighbors at 78 Jessica Court also wanted <br />to have the same fence continue onto their property. The Planning Commission indicated they <br />would recommend approval of such a variance and defer specific action to the City Council in <br />order to allow construction to be coordinated without having to wait an additional month. <br />Staff then had a discussion with Mr. Reeves at which time he indicated that the neighbor wanted <br />to pursue this matter and he asked for our help in allowing it to occur without the need for an <br />additional meeting. He was informed that we would process this matter subject to the payment <br />of the developer deposit fees (minimal in this case) to cover publication of the notice, staff <br />administration fee, and postage. He again represented to us that his neighbor would be in to pay <br />this fee. Given the short time concerns, we then went ahead and published the notice of hearing <br />for this variance. <br />A few days later, after mailed notice was received by the Lesnicks (78 Jessica Court), I received <br />a call from Jacob Lesnick. He indicated that he was unaware of this situation. He was not sure if <br />he wanted to participate at this time as he had not had an opportunity to study it. He further <br />indicated that Mr. Reeves had not discussed this matter with him as of the date of receipt of our <br />notice. <br />Staff is unsure as to where this matter currently rests between the two neighbors. It would be my <br />recommendation that we grant the variance to 78 Jessica Court to allow the construction of a <br />fence to maintain consistency between the properties. Payment of any fees owing would need to <br />occur prior to the issuance of a building permit for this fence. If the property owners at 78 <br />Jessica Court do not desire a variance or wish to proceed with construction of a fence, it would <br />be my recommendation that Mr. Reeves reimburse the City for the costs incurred to prepare this <br />PAGE 8A <br />
