NrsC <br />MEMORANDUM <br />NORTHWEST ASSOCIATED CONSULTANTS <br />COMMUNITY PLANNING - DESIGN - MARKET RESEARCH <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: July 2, 1999 <br />IRE: Little Canada - Reeves Fence Variance <br />FILE NO: 758.09 - 99.23 <br />Terry and Brenda Reeves have requested a variance to construct a fence along the rear <br />property line which abuts County Road C. The appliants state that the proposed fence <br />height of 8 Y feet is intended to increase privacy, reduce noise, and to match the fencing <br />on the rest of the street. <br />Variances from the specific standards of the Zoning Ordinance are to be considered where <br />there is some physical hardship related to the parcel which interferes with reasonable use <br />of the land. Another criterion listed in the Ordinance is that the requested variance does <br />not confer a special privilege which is denied to other properties in the zoning district. The <br />City has approved taller fences along this area in the past due to the alighnment and grade <br />changes which were made to the County Road C roadway, and to increase privacy and <br />security of the rear yards which are exposed to the street. <br />Reasonable use of the rear yards along this area would include both privacy and security. <br />An increase in public use of the trail along this area would also indicate that fences higher <br />than the standard six feet along the rear yards.
