MINUTES CITY' COUNCIL_ September 27, 1989 Mr. Fahey introduced the following resolution and moved its adoption: RESOLUTION NO. 89 -9 -462 - CLOSING THE PUBLIC HEARING The foregoing resolution was duly seconded by Mr. Collova. Ayes (5) Fahey, Collova, Blesener, Scalze, LaValle. Nays (0). Resolution declared adopted. Mr. Blesener introduced the following resolution and moved its adoption: RESOLUTION NO. 89 -9 -463 - APPROVING THE ROGER STANKE VARIANCE REQUEST FOR REAR YARD St.r'xiACK VARIANCE AT 209 RYAN DRIVE DUE TO THE NARROW DEPTH OF THE PROPERTY AND DUE. TO THE SETBACK OF THE EXISTING BUILDING SUBJECT TO THE RECOMMENDATIONS OF THE CITY PLANNER. AND WITH TFiE STIPULATION THAT A LANDSCAPING PLAN BE SUBMITTED AND APPROVED BY 'flit: CITY PLANNER, SUBJECT TO A SUBMISSION OE A BOND BEING POSTED UNTIL LANDSCAPING IS INSTALLED, AND CONTINGENT THAT NO OCCUPANCY PERMIT IS ISSUED ON THE NEW ADDITION UNTIL. THE BLACKTOP IS INSTALLED IN THE FRONT OF 'flit: EXISTING BUILDING AND PROPOSED ADDITION, HOWEVER, IF AN OCCUPANCY PERMIT IS REQUIRED BEFORE THE BLACKTOP IS INSTALLED, THE CITY WILL REQUIRE THAT A BOND BE POSTED FOR 'i'iit: BLACKTOPPING, WITH THE BLACKTOP PLAN TO BE APPROVED BY THE CITY PLANNER, AND FINALLY WZTH APPROVAL TO BE SUBJECT TO THE RECOMMENDATIONS OF THE CITY PLANNER AS CONTAINED IN HIS REPORT DATED SEPTEMBER 11, 1989. The foregoing resolution was duly seconded by Mr. Fahey. Ayes (5) Blesener, Fahey, LaValle, Collova, Scalze. Nays (0). Resolution declared adopted. LaValle asked if the ordinance addressed inoperable cars sitting in the industrial park for extended periods of time. The. City Planner reported that vehicles that are being worked on by a business would not be subject to the Code which addresses unlicensed vehicles in any zoning district. However, such vehicles are not allowed to be stored in the front yard of a business. Page 133
