MINUTES <br />PLANNING COMMISSION <br />AUGUST 12, 1999 <br />wasn't told he needed a CUP and Variance at that time so he could <br />have applied for everything at one time. <br />The City Administrator indicated that the Variance granted to the <br />Stanke property in 1989 was for a rear yard setback Variance. The <br />site plan submitted at that time did not show any outdoor storage. <br />Parking was required to be paved at that time; however, to date <br />that paving has not occurred. The Administrator reported that the <br />Stanke site is not in conformance with the ordinance requirements, <br />and that is the issue that the City is dealing with right now. <br />Stanke agreed, but pointed out the high costs he incurred to install <br />a sprinkler system prevented him from paving the parking areas. <br />Stanke agreed to comply with the paving, landscaping, and <br />screening requirements, but indicated that he would like to ask for <br />City assistance to coordinate the fencing and landscaping issues. <br />Duray asked if any of the other property owners along the north <br />side of Ryan Drive would be coming in for CUP's. The Zoning <br />Administrator reported that the Selland property does not require <br />any additional zoning actions. However, the Wall property <br />directly east of the Stanke property will be in during the September <br />meeting cycle for a CUP. The property at the corner of Ryan <br />Drive and Country Drive will be in at a future meeting as well. <br />The Zoning Administrator pointed out that while the properties <br />along the north side of Ryan Drive do not have rear yards to put <br />outdoor storage in, they do have side yards that can accommodate <br />this storage. The lack of a rear yard does not preclude outdoor <br />storage, it only limits it. <br />The City Administrator also pointed out that the Belland fence is a <br />boundary line fence and not a screening fence. The City can work <br />with the property owners along Ryan Drive, however, it cannot <br />presume to know what their needs are. <br />Stanke indicated that once the lease expires with his tenant, the <br />semi - trailer storage will go away and the need for front yard <br />storage will be eliminated. <br />Montour pointed out that the problem is that a Variance runs with <br />the land and the City cannot put a closure date on a Variance. The <br />Planner agreed. He pointed out that when the City grants a <br />Variance the approval is based on existing conditions. The <br />Page 140 <br />
