MINUTES <br />CITY COUNCIL <br />JULY 28, 1999 <br />Lesnick's needed a variance for the fence. Mrs. Reeves felt they could not <br />be held accountable if City staff is incapable of providing correct <br />information. <br />The City Administrator pointed out that the conversations he has had on <br />this matter have been with Mr. Reeves.. The City Administrator indicated . <br />that he explained to Mr. Reeves why a variance was needed and the fact <br />that the deadline for the July planning cycle had passed. Mr. Reeves was <br />not happy about having to wait for the August cycle. Therefore, in order <br />to accommodate him, the deadline was waived. <br />Mr. Reeves again indicated that it was his understanding that if the <br />Lesnick's did not pay the variance fee by Friday afternoon, a variance for <br />their property would not be processed. <br />Pedersen asked if it were true that a notice should not have been published <br />and mailed until an application with the fee was received. The <br />Administrator stated that that was correct. However, from a customer <br />service standpoint he made a decision to process the variance based on the <br />indication from Mr. Reeves that the Lesnick's were interested. <br />Mrs. Reeves felt that whatever was required of them to process a variance <br />should have been required of the Lesnick's. Because of the City <br />Administrator's customer service efforts, they will be stuck with the bill <br />for the Lesnick variance. <br />Fahey asked for an estimate of the additional expenses. The City <br />Administrator estimated these to be $125. <br />Pedersen felt that an error was made in processing a variance for the <br />Lesnick property without the necessary paperwork. LaValle pointed out <br />that the effort was made by City staff based on Mr. Reeves' comments. <br />There was no one else present from the public wishing to comment on this <br />matter. <br />Upon motion by Fahey, seconded by Scalze, the public hearing was <br />closed. <br />Fahey suggested that action on both the Reeves and Lesnick variances be <br />tabled in order for staff to find out the intentions of the Lesnick's with <br />regard to the fence. Fahey indicated that he is satisfied that there were <br />representations on the part of Mr. Reeves that the Lesnick's were <br />interested in a similar variance.
