Hanson <br />The Council reviewed the Reeves and Lesnick fence variance matter at their July 28th <br />meeting. Based on the discussion that occurred at that meeting, I contacted Mr. Lesnick <br />to determine if he was interested in pursuing a variance for fence height for the portion of <br />his rear yard which abuts County Road C. Mr. Lesnick has informed me that he does not <br />wish to proceed with a variance. Therefore, it would be my recommendation that the <br />Council deny the variance as proposed, and that the City absorb the processing costs <br />incurred thus far which include publication and mailing costs. <br />Secondly, the Council asked about past actions relating to other fence variances along <br />County Road C. There are four Jessica Court properties which back up to County Road <br />C: 2688, 66, 72, and 78 Jessica Court (see map attached). In researching the files, only <br />one of these properties was granted a fence height variance. In September of 1985 Mr. <br />Vitale, 66 Jessica Court, was granted a variance to allow construction of an eight -foot tall <br />fence. However, the fence was constructed to a height of 8 '/z feet. <br />It would be my recommendation that the Council proceed with action on the Reeves <br />variance at this time. Should the Council decide to approve the variance, it would also be <br />my recommendation that fence heights be set at an 8 1/2 foot maximum for consistency <br />along County Road C. <br />Page 3 <br />
