premises by March 31, 2000 and /or complete removal of all personal property and <br />fixtures by that date, Lessee forfeits any remaining right to said personal property <br />and fixtures as well as any remaining amount of security as provided for in <br />Provision #8. <br />4. Lessor acknowledges the receipt of the sum of ($ ) from <br />Lessee on even date herewith, which represents the entire amount of rent due and <br />owing for the period from , 1999 through March 31, 2000. <br />Lessee shall have the right to terminate this lease at any time before March 31, <br />2000 by giving Lessor written notice to such effect and subject to compliance <br />with the terms and conditions of this Lease. In the event that Lessee vacates the <br />premises before the end of the lease, Lessor shall refund to Lessee an amount <br />equaling the rent payment for any days during which Lessee at no time occupies <br />the property. <br />5. During the period of the Lease, Lessee shall hold Lessor harmless and shall <br />indemnify Lessor as to any claims, damages, or injuries resulting from Lessee's <br />occupation and use of the property and improvements to the property. <br />6. During the period of the Lease, Lessee shall provide at Lessee's expense property <br />insurance and commercial general liability insurance. Property insurance shall be <br />in an amount sufficient to protect building and contents on a replacement cost <br />basis. Liability limits shall be a minimum of $500,000 per person and $1,000,000 <br />per occurrence. The insurance shall remain in effect for the duration of the Lease <br />and written verification of insurance shall be provided to Lessor. Lessor shall be <br />named as an additional insured on Lessee's commercial general liability insurance <br />and Lessee shall pay any resulting additional cost. Should any damage occur to <br />property during the term of the lease, any insurance proceeds shall be payable to <br />Lessor. <br />7. During the period of the Lease, Lessee shall not enter into any sublease or allow <br />any lien or interest to attach to the property other than real estate taxes as set forth <br />in paragraph 2. Lessee shall pay all expenses for the maintenance and use of the <br />property during the period of the Lease. <br />8. Lessor acknowledges the receipt of the sum of Ten Thousand Dollars ($10,000) <br />from Lessee on even date herewith. This sum shall be held by Lessor as security <br />for the payment of any sewer and water charges accruing to the property during <br />the period and to guarantee compliance with the terms of this Agreement. <br />9. During the term of this Lease, Lessor shall have the right to enter upon the <br />property for purposes associated with the redevelopment of this site so long as <br />said entry does not unreasonably interfere with the operation of the car wash use <br />existing upon the site. Potential entries on the site may be associated with the <br />demolition of the remaining two buildings (metal shed and vacant block <br />structure), soils exploration, and other uses related to redevelopment. <br />
