CITY OF LITTLE CANADA <br />RESOLUTION FOR VACATING A DRAINAGE AND UTILITY EASEMENT <br />WHEREAS, the City Council of Little Canada has determined to vacate a drainage and <br />utility easement over Lot 1, Block 1, Little Canada Mall Addition; <br />AND WHEREAS, a public hearing was held on September 8, 1999 before the City <br />Council in the City Center after due published and posted notice had been given by the <br />City Administrator on August 24 and August 31, 1999, a reasonable attempt was made to <br />give personal notice to all affected property owners, and all persons interested were given <br />an opportunity to be heard; <br />AND WHEREAS, any person, corporation or city owning or controlling easements <br />contained upon the property vacated, reserves the right to continue maintaining the same <br />or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove <br />or otherwise attend thereto; <br />AND WHEREAS, it appears that it will be in the best interest of the City to vacate such <br />easement; <br />AND WHEREAS, four -fifths of all members of the City Council concur in this <br />resolution; <br />NOW, THEREFORE, BE IT RESOLVED, that the following is hereby vacated: <br />That part of the Utility and Drainage Easement as dedicated in Lot 1, Block 1, <br />LITTLE CANADA MALL ADDITION, Ramsey County, Minnesota being a <br />10,00 foot wide strip, the west and south line of which is described as follows: <br />Beginning at the northeast corner of Lot 35, J. F. Eisenmenger's Garden <br />Lots, Ramsey County, Minnesota; thence southerly, along a westerly line <br />of said Lot 1, a distance of 276.77 feet to a southwest corner of said Lot 1; <br />thence easterly along a south line of said Lot 1, a distance of 100.00 feet <br />and said line there terminating, <br />Which lies southerly of a line between the northeast corner of said Lot 35 and the <br />northwest corner of Lot 37, said J. F. Eisenmenger's Garden Lots, and which lies <br />westerly of the following described line: <br />Commencing at the northwest corner said Lot 37; thence southerly, along <br />an easterly line of said Lot 1, a distance of 107.83 feet to the point of <br />Page 4 <br />
