MINUTES <br />CITY COUNCIL <br />SEPTEMBER 22, 1999 <br />ZONING CODE - <br />OUTDOOR <br />STORAGE IN <br />PUBLIC <br />DISTRICT <br />Fahey suggested that it was not good policy to base a decision related to <br />variances or zoning on a popularity contest. <br />Mr. Morelan introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 99 -9 -252 — TABLING THE CONCEPT <br />REZONING REVIEW OF THE McCUMBER AND BUETOW <br />PROPERTIES UNTIL THE OCTOBER 13, 1999 CITY COUNCIL <br />MEETING AND INSTRUCTING THE CITY PLANNER TO REVIEW <br />THE EFFECT THAT A REZONING TO BW WOULD HAVE ON <br />THESE PROPERTIES AS WELL AS OUTLINE THE DIFFERENCES <br />BETWEEN THE PROVISIONS IN THE 1-1 AND BW ZONING <br />DISTRICTS <br />The foregoing resolution was duly seconded by Fahey. <br />Ayes (4) Morelan, Fahey, Scalze, Pedersen. <br />Nays (1) LaValle. Resolution declared adopted. <br />LaValle indicated that he did not feel three weeks was adequate time to <br />research this matter. <br />Fahey opened the public hearing to consider an amendment to the Zoning <br />Code relative to the addition of outdoor storage of materials as a <br />Conditional Use in the Public District. The Planning Commission <br />recommended approval of this amendment. <br />Scalze pointed out that there are several areas in the City zoned Public, <br />and expressed concern that allowing outdoor storage of materials as a <br />CUP would pose problems in some areas. She suggested that there be a <br />qualification added which would limit this storage to those areas zoned <br />Public which are surrounded by I -1 zoning. <br />The City Planner pointed out that the outdoor storage of materials would <br />require a Conditional Use Permit and that these materials would have to be <br />accessory to the principle use of the property. The Planner also noted that <br />the proposed amendment requires that this storage be necessary for the <br />health, safety, and welfare of the community. <br />Scalze noted that the amendment is being proposed to address storage at <br />the City's public works garage. She suggested that if that garage were <br />located in the middle of a residential neighborhood, it may not be a good <br />idea to allow outdoor storage. Therefore, she suggested that there be a <br />limitation based on surrounding zoning. <br />Page 41 <br />
