PRESENTED BY <br />COMMISSIONER <br />BOARD OF WATER COMMISSIONERS <br />RESOLUTION — GENERAL FORM <br />Benanav <br />No 4659 <br />DATF September 21, 1999 <br />WHEREAS, The Board of Water Commissioners does possess certain right -of -way easement <br />located in the NW quarter of Section 6, Township 29 North, Range 22 West, Ramsey County, <br />Minnesota, adjacent to Woodlyn Avenue ( "Premises "), said Premises containing the Board's two <br />90 -inch Vadnais Conduits; and <br />WHEREAS, The City of Little Canada having entered into an Agreement with the Board of <br />Water Commissioners dated July 1966, for the purposes of locating certain public works within <br />the Board's rights -of -way in Ramsey County; and <br />WHEREAS, The City of Little Canada desires to construct a storm sewer line within Woodlyn <br />Avenue adjacent to the Premises, to make surface grade modifications within the Premises and to <br />cause storm water to flow overland onto the Premises; and <br />WHEREAS, Water Utility staff has prepared a Twenty -First Rider to that Agreement of July 13, <br />1966, which sets forth the conditions of construction and access over the Premises and which <br />protects the Board's rights, interests, and facilities; and <br />WHEREAS, The office of the city attorney has reviewed and approved said Twenty -First Rider as <br />to form, and staff recommends that the Board approve said Twenty -First Rider; now, therefore, be <br />it <br />RESOLVED, That the Twenty -First Rider to Agreement with the City of Little Canada is hereby <br />approved and that the proper officers of the Board are hereby directed to execute said Twenty -First <br />Rider on behalf of the Board. <br />Water Commissioners <br />Yeas Nays <br />Arcand <br />Benanav <br />Reiter <br />Vice President Haselmann <br />In favor 4 Opposed 0 <br />Adopted by the Board of Water Commissioners <br />PAGE 196 <br />September 21, <br />19 99 <br />SECY. <br />
