We find the plat <br />acceptable. The plat does contain a drainage and utility easement throughout all of Lot 18, <br />which is the common space. This will accommodate the public sanitary sewer and water <br />services. One minor issue is that the storm sewer in this development should be considered a <br />private improvement, however, it will fall in the public drainage and utility easement. I would <br />suggest in the developer's agreement it should be spelled out that the storm sewer is a private <br />improvement and the responsibility of the association to operate and maintain. <br />We have contacted Jason at E.G. Rud and Sons, Inc. regarding this final plat. We questioned <br />whether there were any underlined easements that needed to be vacated prior to recording the <br />plat. He indicated that they are none, however, he did indicate that the underlying plat of Water <br />Works Second Addition has not been recorded yet. It is being prepared by another surveyor. <br />Therefore, it is important that the Water Works Second Addition plat be recorded prior to <br />Blacktern Office Park. <br />If you have any questions regarding these comments please call. <br />Sincerely, <br />Howard R.
