Hanson <br />Email: cityhall@ci.little- canada.mn.us <br />MEMORANDUM <br />TO: Mayor Fahey & Members of the City Council <br />FROM: Greg Schroeder, Public Works Director <br />DATE: December 10, 1999 <br />RE: Night Construction on Highway 36 <br />Next summer, MNDOT will be making some improvements to Trunk Highway 36 from <br />Edgerton Street in Little Canada on west to Stillwater. The work will consist of mill and <br />overlay, micro surfacing, median barrier upgrade, guardrail upgrade, some hydraulic <br />improvements, and shoulder improvements to accommodate buses. (See attached MNDOT letter <br />dated November 29, 1999.) This work will impact the adjoining residential properties along <br />Viking Drive, County Road B2, Gilanderi Lane, and Arcade Street. <br />At a November 15, 1999 meeting with MNDOT, it was determined the mill and overlay portion <br />of this project would cause major congestion and increase traffic on local roads within Little <br />Canada. To reduce cost, reduce construction time, and reduce traffic congestion, MNDOT <br />would like to perform only the mill and overlay work at night. <br />The City's Municipal Code Section 2801.040 sets a noise level limit in a residential district at 60 <br />dBA in the daytime (7 a.m. to 10 p.m.) and 50 dBA in the nighttime (10 p.m. to 7 a.m.) as <br />measured at the property line of the source. The Code also states that construction equipment <br />being operated at a construction site shall not exceed a L10 noise level of 85 dBA at a distance of <br />50 feet. A L10 noise level is a noise level which is exceeded 10% of the time for a one -hour <br />survey. <br />Section 2801.090 sets operational limits on construction activities that exceed the requirements <br />outlined in Section 2801.040 can only occur between the hours of 7 a.m. and 10 p.m. on <br />weekdays and between 9 a.m. and 9 p.m. on Saturdays. No Sunday work is allowed. <br />Based on the above, MNDOT is requesting a variance from our noise ordinance that would <br />enable them to perform only the mill and overlay work during the night hours. As stated in <br />Section 2801.110, it is recognized that under certain circumstances it would be impossible for a <br />Page 189 <br />
