MINUTES <br />CITY COUNCIL <br />NOVEMBER 22, 1999 <br />CUP — 3151 <br />COUNTRY DR — <br />COSTANZO <br />BUETOWfr <br />MCCUMBER. <br />PROPERTIES — <br />CONCEPT <br />REZONING <br />Council noted that the Planning Commission has tabled action on <br />the application for Conditional Use Permit for open and outdoor <br />storage of materials and equipment as an accessory use at 3151 Country <br />Drive pending additional information. <br />Pedersen introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 99 41 -239 — TABLING ACTION ON THE <br />APPLICATION FOR CONDITIONAL USE PERMIT FOR 3151 <br />COUNTRY DRIVE AS REQUESTED BY CARL COSTANZO <br />PENDING A RECOMMENDATION FROM THE PLANNING <br />COMMISSION <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Pedersen, Scalze, LaValle, Fahey, Morelan. <br />Nays (0). Resolution declared adopted. <br />The Council reviewed the City Planner's report dated November 19, <br />1999 relative to the concept rezoning of the Buetow and McCumber <br />properties. It was noted that the Planner is suggesting a B -1 District <br />(Business Industrial) for these properties. The Planner note¢ that the <br />property owners were concerned about the rezoning of their properties to <br />PUD (Planned Unit Development), specifically with references to future <br />residential use of the property and with the requirement that Industrial <br />uses be required to go through the CUP process. The Planner indicated <br />that while he has removed the reference to the future residential use, he is <br />recommending that any industrial uses of the property be required to have <br />a Conditional Use Permit. <br />Mr. Bartholie, representing the McCumber's, indicated that they have met <br />with City staff to discuss the issues on two different occasions. He <br />indicated that they originally had three concerns, two of which have been <br />resolved. Their remaining concern is that industrial uses will require a <br />CUP rather than being permitted uses. Bartholie pointed out that there are <br />two existing tenants of the McCumber property that this would affect as <br />well as pointed out the effect this would have on the McCumber's ability <br />to attract new tenants. Bartholie indicated that tenants will not want to go <br />through the CUP process and will Look for other locations. He also felt <br />that the CUP requirement will affect the McCumber's lease negotiations <br />with potential tenants. Bartholie requested that industrial uses be allowed <br />as permitted uses rather than conditional uses. <br />Page 101 <br />
