This was initially put into the ordinance when we were thinking that the Interim
use would be made an allowance of the PUD District. However, since we are now going
to establish an "I -2" District, the Ordinance language should read:
Interim Uses. The following are interim uses in the 1-2" District, subject to
the issuance of an Interim Use Permit, per the Conditional Use Permit
procedures listed in Section 921 of this Ordinance.
An interim Use is a zoning technique which a City can use to allow and regulate land uses
for a specific period of time. The primary requirement is that the applicant agree to the
termination date, To issue an Interim Use Permit, the Zoning Ordinance needs to have a
proceeds specified. Some Cities will establish a new process in the Administration portion
of the Zoning Ordinance. Others will refer to a process already established, such as the
Conditional Use Permit process, as we have done here.
To do the former, we would have to create an additional ordinance section which govems
the IUP process - presumably a different one than the CUP process we now have. On the
assumption that we did not intend to establish a different process, and that we wanted to
minimize the amount of new language, we made the reference to Section 921 in the
proposed text.
Let me know if you need anything additional on this item.
5775 WAYZATA BOULEVARD, SUITE 555 ST.
