MINUTES <br />PLANNING COMMISSION <br />MAY 13, 1999 <br />of the setback issue. It was noted that construction began after Thul <br />applied for the building permit but before it had been issued. <br />Keis noted that there must be a hardship present to justify the variance and <br />prevent a precedent from being set. The Commission discussed the <br />distinctions that could be made in this situation. <br />Barraclough recommended approval of the rear yard setback variance <br />requested by Mr. Rick Thul for property at 165 East Viking Drive based <br />on the following: <br />• The size of the lot is three times that of the minimum <br />residential lot size in the City; <br />• The original garage structure at the rear of the property is <br />approximately 43 years old and was constructed prior to the <br />adoption of zoning regulations; <br />• The applicant has demonstrated a need for a tuck -under garage <br />to be added to the existing house due to safety concerns and the <br />isolated nature of the area. <br />The resolution was duly seconded by Kraemer. <br />Motion carried 7 — 0. <br />CHANGE The Zoning Administrator asked if the Commission would consider <br />JUNE changing its June meeting to Wednesday, June 9`h, from Thursday, June <br />MEETING 10th, due to the fact that she cannot be present on June 10`h and there are <br />several Conditional Use Permit applications scheduled for the <br />Commission to consider that evening. <br />ADJOURN <br />It was the consensus of the Commission to change the meeting provided <br />that there were no conflicts on the part of the Commissioners. The <br />Commissioners are to inform staff of any conflicts. <br />Montour recommended the meeting be adjourned. <br />Motion seconded by Keis. <br />Motion carried 7 — 0. <br />Page 76 <br />
