5. Right of Entry. The Developer hereby grants the City, <br />its agents, employees, officers and contractors a right <br />of entry to enter the Property to perform all necessary <br />inspections deemed appropriate by the City during the <br />operation of the material storage and processing by the <br />Developer. The right of entry shall expire after the <br />cessation of activities pursuant to the Development <br />Contract. <br />6. Cleanup and Dust Control. The Developer shall promptly <br />clear any soil, earth or debris resulting from work by <br />the Developer of its customers, agents or assigns. <br />Developer's responsibilities shall also include <br />sweeping public streets in the vicinity of the interim <br />use operation to remove any debris tracked from the <br />site onto the public streets. Developer shall <br />constantly monitor conditions and sweep as needed or <br />within 24 hours notice by City. <br />Dust control will consist of at least daily watering of <br />the service roads and yard contained within the <br />property described on Exhibit A with Developer's self <br />contained water truck; subject to appropriate <br />modifications due to prevailing weather conditions. At <br />all times during crushing operations, Developer shall <br />supply water by the use of at least one 14 inch pipe <br />and one 31 inch hose directly to the crusher, and one 3/ <br />inch hose to the conveyor. Developer shall modify dust <br />control methods as necessary to ensure other properties <br />in the area are not negatively impacted by this interim <br />use. <br />10. Interim Use. Subject to compliance with the terms of <br />the Development Contract, dated October 1, 1990, and <br />all Amendments thereto, and after issuance of an <br />interim use permit, the Developer shall be permitted to <br />operate storage, stockpiling, and processing (crushing) <br />of aggregate materials and other activities relating to <br />the same for the purpose of making recycled concrete <br />and asphalt aggregate, as well as the storage, <br />stockpiling and processing of topsoil (black dirt), as <br />an interim use in an I -2 District. <br />Prior to the establishment of this interim use by the <br />passage of Little Canada Ordinance No. 485 on April 27, <br />1999, and the publication of Little Canada Ordinance <br />2 <br />PAGE 4 <br />
