Hanson <br />Ryan Contracting has asked the City to delete the final lift of asphalt from its contract in order to close out <br />Improvement #94 -2. Given recent reductions in oil prices as well as the amount of work we have planned <br />for 1999, I informed Paul Heuer of Bonestroo that we would consider this matter subject to a complete <br />close -out of the entire contract and a waiver of any and all possible claims by Ryan against the City. <br />Attached is correspondence received from Ryan Contracting, Inc. detailing what they feel are the <br />outstanding monetary issues that needed to be resolved. I have also included Barr Engineering's response <br />on behalf of the Ramsey - Washington Metro Watershed District dealing with items they were involved <br />with. As my notes indicate on Ryan's memo, items 1 and 6 should be paid to Ryan Contracting. Items 2, <br />5, 7, and 8 should not be paid based on recommendations of either Barr Engineering or Bonestroo. Items <br />4 and 9 are being verified by Paul Heuer and a final recommendation is pending. Item 3 deals with the <br />extension of Centerville Road culvert. We will owe some money on this item. At issue is $15,000 was <br />for a completed job that was not achieved. However, we also received a significant savings by not having <br />to remove materials from Arcade that resulted in the shortfall of planned fill as indicated in item 5. This <br />will take additional research. <br />Paul Heuer and I will be meeting with Tom Ryan of Ryan Contracting on Tuesday afternoon. It is my <br />goal that we are able to resolve all outstanding issues at that time and put ourselves in a position to make <br />a final recommendation to the Council at Thursday's meeting.
