The <br />Developer shall warrant all required improvements and work to be performed <br />for one (1) year after its completion and acceptance by the City. On or <br />before January 15, 1984, the Developer shall file with the City a Final <br />Plat for Phase I of the PUD as described in paragraph 19 of this Agreement. <br />6. Easements. The Developer shall provide ulility'easements <br />along all platted lots as specified in the Subdivision Ordinance. In addi- <br />tion, the Developer shall provide fifteen (15) foot public utility easements <br />over all newly constructed sanitary sewer, water main and storm sewer pipe- <br />lines which are on private property in recordable form. <br />A public easement for emergency vehicle access shall he provided <br />and recorded. Said easement is to provide for a looped circulation system <br />between the cul -de -sac turnaround of Spruce Street and County Road C. <br />Furthermore, the easement is to ensure maintenance for year -round access. <br />7. Ownership of Improvements. Upon completion of the work and <br />construction required by the Agreement and acceptance by the City, the <br />improvements including, but not limited to, sanitary sewer, water main, <br />storm sewer, and public roads (Spruce Street), shall become City property <br />without further notice or action. <br />The Homeowners Association and the Apartment Owners shall retain <br />the ownership of the PUD internal private street system, including the <br />Emergency Vehicle access, and shall be responsible for street maintenance <br />and snow removal for all private streets within the PUD. <br />8. License_ The Developer hereby grants the City, its agents, <br />employees, officers and contractors a license to enter the PUD to perform all <br />necessary work, maintenance and /or inspections deemed appropriate by the City <br />during the installation of public improvements by the Developer and prior to <br />approval of final plats. The license shall expire after the public improve- <br />ments installed pursuant to the development contract have been installed and <br />accepted by the City and after approval of final plats. <br />Page. 66 <br />
