Property Values. Applicant's for conditional use permit must satisfy the City's CUP <br />evaluation criteria. In doing so, the applicant must demonstrate to the city that the <br />proposed building re- location will not negatively impact the neighboring property values. <br />The requirement relates to size, character, and architectural appearance of the structure <br />to be re- located. <br />Building Code. As an additional condition of CUP approval, the subject structure must <br />comply with the applicable requirements of the Uniform Building Code. Therefore, the <br />building official must inspect the garage at its current location, and at the desired location <br />once the structure has been moved. Additionally, no accessory building or detached <br />garage for a single - family dwelling shall occupy more than twenty -five (25) percent of the <br />area of the rear yard, nor if the total floor area of the garage may not exceed 1,000 square <br />feet. <br />The applicant should provide proof to the City that the re- location is be conducted by a <br />licensed mover in accordance with the State requirements, and notify the City of the route <br />and exact time of the re- location. <br />RECOMMENDATION <br />Based on the preceding information, the proposed re- location of a garage onto an existing <br />city lot on Edgerton Street appears to be consistent with the requirements of the <br />Conditional Use Permit process. Therefore, we recommend approval of the CUP subject <br />to the following conditions: <br />The Planning Commission and City Council find that the CUP will mot depreciate <br />property values in the neighborhood. <br />2. The building official inspects the home at its current location and that the applicant <br />complies with all building official requirements for moving and upgrades. <br />3. The garage meets all minimum square footage requirements for a detached garage. <br />4. The garage must be located on the lot so as to meet all required setbacks of the R -1 <br />Single- Family Residential Zoning District. <br />5. The applicant provide proof that the move is being conducted by a licensed mover <br />in accordance with the applicable State requirements. <br />6. The applicant inform the City as to the route and exact time of the move. <br />Page 32 <br />
