6. The proposed site is or will be compatible with the present and future land <br />uses of the area. <br />The property is zoned B -3, and commercial recreational uses are conditionally <br />permitted within that zoning district. The existence of complaints indicates that <br />there are incompatibilities. Either a reduction in operating hours or adequate <br />screening will be needed to alleviate existing and potential incompatibilities. <br />7. The proposed use conforms with all performance standards contained herein. <br />Because the City has an established policy regarding screening commercial activity <br />from residential area, it may require the applicant to screen the property if deemed <br />necessary. <br />8. The proposed use will not tend to or actually depreciate the area in which it <br />is proposed. <br />As long as the noise complaints are attended to in some fashion and the property <br />remains well maintained, the extension of operating days to six (6) should not <br />depreciate the area. <br />9. The proposed use can be accommodated with existing public services and <br />will not overburden the City's service capacity. <br />The extension of operating days for the volleyball court will have no effect on the <br />City's public service capacity. <br />RECOMMENDATION <br />Based on the above review, our office would recommend approving the request for <br />extension of their conditional use permit, subject to the following conditions: <br />1. The provisions of Section 911.040 (F) of the Municipal Code are considered and <br />satisfactorily met. <br />2. Due to citizen complaints, our office recommends that the extension of the <br />conditional use permit be appoved only if adequate screening is provided to reduce <br />noise and lighting concerns.
