MINUTES <br />CITY COUNCIL <br />MAY 13, 1998 <br />The City Administrator noted that discussion of this intersection occurred <br />at the assessment hearing for the project. At that time, we indicated to our <br />residents that the issue would be addressed. <br />Fahey asked who owns the street right -of -way in this area. The <br />Administrator indicated that the curb line in question lies in Maplewood <br />right -of -way. The City Attorney pointed out that the right -of -way is not <br />owned by the City of Maplewood, but is held in the public interest. The <br />Attorney suggested that if Maplewood does not agree to modify the curve <br />so that it meets design specifications, the City has the option to pursue a <br />court order to do so. <br />Fahey suggested that Little Canada must assume that the Maplewood City <br />Council will respect the original agreement between the two cities. If not, <br />then Little Canada will have to initiate whatever action is necessary to <br />protect its citizens. <br />The City Administrator recommended that the Mayor and Acting Mayor <br />join him in discussing this matter with the Maplewood City Council. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 98 -5 -108 — APPOINTING THE MAYOR, ACTING <br />MAYOR, AND CITY ADMINISTRATOR AS A COMMITTEE TO <br />ADDRESS THE MAPLEWOOD CITY COUNCIL ON THE ISSUE OF <br />THE ARCADE STREET CURVE <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (4) LaValle, Pedersen, Fahey, Scalze. <br />Nays (0). Resolution declared adopted. <br />The City Administrator recommended that prior to addressing the <br />Maplewood City Council, the committee get together to review the <br />information that it will present. Scalze suggested it may be helpful to get <br />some film of school buses trying to navigate through this intersection. <br />ALCOHOL The Council reviewed the proposal submitted by the North Suburban <br />COMPLIANCE Tobacco Compliance Project and the University of Minnesota <br />CHECKS Epidemiology Program for alcohol compliance checks. It was noted that <br />participation in this program is voluntary and has not been mandated by <br />State Law. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />5 <br />Page 8 <br />
