CITY OF LITTLE CANADA <br />ORDINANCE NO. <br />AN ORDINANCE AMENDING SECTION 2302.250. <br />LOCATION OF EQUIPMENT, A. UNDERGROUNDING, <br />OF THE MUNICIPAL CODE OF THE CITY OF LITTLE CANADA <br />RELATING TO THE UNDERGROUNDING OF CABLE TELEVISION EQUIPMENT <br />THE CITY COUNCIL OF LITTLE CANADA HEREBY ORDAINS AS FOLLOWS: <br />Section 1. <br />Section 2302.250. A. of the Municipal Code of the City of <br />Little Canada is hereby amended to read as follows: <br />2302.250. LOCATION OF EQUIPMENT. <br />A. Undergrounding. Unless otherwise permitted by an <br />existing franchise or Minn. Stat. 216B.34, or unless <br />existing above - ground equipment is repaired, or unless <br />undergrounding is not feasible, such as the provision <br />of electric service at certain voltages, new <br />construction, the installation of new equipment, and <br />the replacement of old equipment shall be done <br />underground or contained within buildings or other <br />structures in conformity with applicable codes, unless <br />otherwise agreed to by the City in writing, and unless <br />such agreement is reflected in applicable permits. <br />Notwithstanding this section and Section 2302.060, <br />MediaOne North Central Communications Corp, and its <br />successors and assigns, acknowledge and understand that <br />after July 21, 1998, all new cable television equipment <br />construction shall be done underground, regardless <br />whether other utilities currently exist overhead in <br />that particular area. In addition, MediaOne North <br />Central Communications Corp, its successors and <br />assigns, acknowledge and understand that after July 21, <br />1998, existing overhead cable television equipment <br />shall be relocated underground in any area where other <br />utilities are located underground or other utilities <br />Page 22 <br />
