MINUTES <br />CITY COUNCIL <br />JULY 8, 1998 <br />Morelan asked if the franchise agreement or rights -of -way ordinance <br />expressly states that. <br />Gibbs replied that he thinks this is required by State Statute. Gibbs <br />suggested that Media One could send the City a letter interpreting this <br />obligation. However, there is no doubt in their minds that Media One <br />would bring its plant underground if NSP or other utilities go <br />underground. <br />Morelan stated that he would like to see any new cable TV construction go <br />underground regardless of the fact that NSP might be overhead. <br />Gibbs stated that Media One does not disagree. <br />Kevin Griffin, Media One, reported that currently 40% of the cable TV <br />plant in Little Canada is underground. Griffin explained the architecture <br />of the system and the upgrade from the current 450 megaherst system to <br />750 megaherst. Griffin further indicated that the upgrade will improve the <br />reliability of the existing coaxial cable. Any cable which is abandoned or <br />broken will be removed. Griffin stated that the fiber which will be added <br />is not new construction, but rather an enhancement to the existing system, <br />and will allow the system to serve smaller pockets of neighborhoods in <br />conjunction with the coaxial cable. To bring the plant underground would <br />put a financial burden on cable customers. <br />Morelan stated that he did not have too big a problem with the smaller, <br />transparent fiber which will be added and wrapped with the coaxial cable. <br />However, he did not want to see additional cable hung from utility poles <br />which do not currently have cable. Morelan stated that he would like to <br />see this plant go underground. <br />Griffin replied that that was not a problem. <br />Gibbs replied that that was Media One's understanding of new <br />construction. <br />Pedersen stated that page 10, paragraph 4 of the franchise agreement does <br />not say this. <br />Gibbs indicated that Media One would be prepared to consider this new <br />construction. <br />Morelan asked if the City was adequately covered in the franchise <br />agreement and rights -of -way ordinance to make this happen. <br />Page 27 <br />
