DATE: March 20, 1998 SUBJECT: Tuesday Meeting Please find enclosed a draft "work in process" of the franchise which is being negotiated with MediaOne. As you can see, a vast majority of the issues have been resolved, but there are still some language disagreements which still need worked out. We wanted to begin the presentation of the document to you, even as we continued to work out the details and language, so that your policy input can commence as soon as possible. We still anticipate a completed document for your April meeting. Even though we may get the document to the cities in time for its adoption before the expiration date, the process of ordinance effectiveness in each city may take us beyond the April deadline. Therefore, we will ask that you recommend to the cities that they extend the effective date of the franchises long enough for each city's individual ordinance - making procedures to take effect. We think another 90 days would insure that none of the ordinances lapse, even though the cities will have the final franchise long before that. THE ENCLOSED FRANCHISE NEED NOT GO TO YOUR CITIES UNTIL WE HAVE RESOLVED ALL ISSUES AND HAD THE COMMISSION SIGN OFF ON THE ENCLOSED. As you review the enclosed, remember that the final negotiated deal with the company has many parts, and that no part of the negotiations is final until all parts are accepted by all parties. You should also note that the company just received this last draft, and will no doubt have additional counter - proposals upon its review of the enclosed.
