MINUTES <br />PLANNING COMMISSION <br />SEPTEMBER 13, 2012 <br />ZONING <br />CODE <br />AMENDMENT — <br />INDOOR RETAIL <br />SALES ZONING <br />ADMINISTRA- <br />TIVE PERMIT <br />The Commission discussed this issue and was in agreement that religious <br />institutions should be limited to the Public /Semi - Public Zoning District. It <br />reviewed the recommended amendment to the Zoning Code's definition of <br />Church as proposed by the Planner. Maleitzke suggested that this <br />definition be submitted to the City Attorney for review and comment. <br />Barraclough recommended approval of the Amendment to the Zoning <br />Code relative to the definition of Assembly as recommended by the City <br />Planner and outlined in his report dated September 7, 2012. <br />Motion seconded by Duray. <br />Motion carried 7 — 0. <br />The City Planner reviewed his report dated September 7, 2012 regarding <br />indoor used car sales in the Industrial Districts. The Planner reported that <br />City staff has noted that in some cases properties with Indoor Used Car <br />Sales licenses as well as Auto Repair licenses may be using the indoor <br />display space reserved for vehicles for sale for the auto repair portion of <br />the business. This results in the vehicles for sale being moved outdoors. <br />it has been difficult for enforcement staff to distinguish between the <br />vehicles for sale and the vehicles waiting to be repaired. Therefore, staff <br />has requested that additional conditions be placed in the Code that would <br />regulate indoor sales and avoid the conversion to outdoor sales lots. <br />The City Planner reviewed proposed modifications that would help to <br />ensure that the Indoor Sales CUP is not being misused. These include <br />submission of a floor plan of the building, requiring that the sales floor be <br />accessible directly to the outside, physically separating the sales floor <br />from other used in the building, and specifically stating that no outdoor <br />storage of vehicles for sale or which are waiting for repair may be stored <br />outside under either the CUP for indoor sales lot or the CUP for auto <br />repair. <br />Knudsen asked the impact on existing Indoor Sales Licensees. The <br />Planner noted that those license holders are grandfathered in, but pointed <br />out that these license holders are still not allowed to store vehicles for sale <br />outside under the current Code requirements. A new licensee would be <br />would be subject to the additional conditions as described in his report. <br />The Planner also noted that there is an additional Outdoor Storage license <br />currently required for any outdoor storage. Provisions of that license are <br />not being proposed to be changed. <br />Knudsen asked why the additional conditions are being proposed. The <br />Planner indicated that the new language separates the vehicle display <br />- 12 - <br />
