City of Little Canada, Minnesota Ordinance No. 2012 -9 -733 AN ORDINANCE ESTABLISHING A TWELVE MONTH MORATORIUM WITHIN THE CITY OF LITTLE CANADA PROHIBITING THE APPLICATION FOR AND /OR THE ISSUANCE 01? LICENSES OR ZONING APPROVALS, AND /OR THE OPERATION OF NEW BUSINESS PREMISES FOR THE FOLLOWING USES: AUTOMOBILE REPAIR, MINOR; AUTOMOBILE REPAIR, MAJOR; AUTOMOBILE REPAIR, SALVAGE; NEW OR USED AUTOMOBILE SALES, INDOOR; NEW OR USED AUTOMOBILE SALES, OUTDOOR SALES LOTS; JUNKING OR SALVAGE OF AUTOMOBILES, AND /OR THE SALES OF USED PARTS FROM USED OR SALVAGE VEHICLES. The City Council of the City of Little Canada hereby ordains: Section 1. MORATORIUM ESTABLISHED (a) Preamble and Findings The City Council finds the following: (1) That the repair, salvage, and sale of motor vehicles in the City of Little Canada raises issues of public safety, land use, economic development, compliance with local ordinances, compliance with State of Minnesota vehicle title regulations, and other related ordinances and laws; and (2) The Council further finds that changes to the City's regulations are necessary to ensure that all applicable laws and ordinances are sufficient, enforced and complied with; and (3) The Council further finds that these changes will require study and analysis prior to enactment, and as such, the City adopts this interim moratorium ordinance to protect the planning process prior to consideration and adoption of revisions to the City's codes. (b) Moratorium Scope: Activities Prohibited (1) In accordance with the findings set forth in the Preamble to this ordinance and pursuant to the authority of Minnesota Statutes 462.355 (Subd. 4), there is hereby established a moratorium on the application for zoning permits, licenses, or other regulatory approvals for Automotive uses otherwise allowed and regulated by Chapters 6
