Finance No. THIRTY - SECOND RIDER TO AGREEMENT THIS AGREEMENT, made this 11th day of September, 2012; by and between the BOARD OF WATER COMMISSIONERS OF' THE CITY OF SAINT PAUL ( "Board "), and the CITY OF LITTLE CANADA, County of Ramsey, State of Minnesota, ( "City "), being the Thirty - Second Rider to that certain Agreement made by and between the Board and the City the 13'x' day ofJuly, 1966, and by this reference incorporated herein and made part hereof and with the sane intent, purpose and effect as if said Agreement were set forth herein verbatim. WHEREAS, the Board is owner o1' a right -of -way, which varies in width between 100 feet and 170 feet, located in the South half of the SW quarter of Section 31, Township 30 North, Range 22 West, and in the North half of the NW quarter of Section 6, Township 29 North, Range 22 West, in Ramsey County, Minnesota, south of Blacktern Pond and west of Spruce Street in the city of Little Canada as depicted in Exhibit A, the "Premises " ;; and WHEREAS, the City desires to enter upon certain portions of said Premises to make surface grade modifications and to construct and maintain an 8 -foot wide hard surface trail; and WHEREAS, the Board is willing to grant said permission to the City consistent with the requirements and safety of the works of the Board.
