MINUTES <br />CITY COUNCIL <br />OCTOBER 17, 2012 <br />assessment given we are allocating the 50% assessable share. The goal is <br />to provide equity in the assessment among properties impacted throughout <br />the project. The Administrator also pointed out that for road <br />reconstruction projects, the current residential rate is capped at <br />approximately $60 per front foot, with the commercial rate at double that <br />amount. <br />McGraw asked how many properties there were like this one in the City. <br />The Administrator pointed out that The Lodge is a property that has a <br />combination of commercial and residential uses. He indicated that in <br />assessing a project, the City must base assessments on benefits received. <br />He pointed out that property owners have the right to object to <br />assessments. The Administrator informed Mr. Henry that in order to <br />object, he must submit a written objection this evening. This then <br />preserves his right to contest the assessment in district court within the <br />next 30 days. <br />Durose noted that his property only has 51.5 feet of frontage and asked for <br />an explanation of the frontages listed on the assessment roll. The City <br />Engineer explained the odd - shaped lot formula which was applied to the <br />Durose property. He noted, however, that a per unit assessment is <br />proposed for all residential properties on Rosewood Drive. <br />It was noted that there is no one else present from the general public <br />present to comment on this matter. It was also noted that the City has <br />received no written objections to the assessment. <br />Upon motion by Boss, seconded by McGraw, the public hearing was <br />closed. <br />McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2012 -10 -182 — ADOPTING THE ASSESSMENT <br />FOR IMPROVEMENT NO. 2011 -02, ROSEWOOD DRIVE (FROM <br />COUNTY ROAD C TO THE CUL -DE -SAC) BY MILL AND OVERLAY <br />OF BITUMINOUS ROAD SURFACE AS WELL AS <br />REPAIR/REPLACEMENT OF DAMAGED CONCRETE CURB AND <br />GUTTER AS PRESENTED BY THE CITY ENGINEER <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (4). <br />Nays (0).
