restrictions on it which limit it to storage, which may deter certain commercial <br />buyers. In this sense, rezoning the subdivided parcel so that the garage falls in <br />the Public District, in which its intended use is storage, would be beneficial to <br />both the governmental institution in question and the potential owner of the <br />former Norm's Tire commercial property to the west. <br />5. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. <br />Comment: The rezoning of the subdivided parcel to the Public District should not <br />require any additional public services. The land being subdivided is to be <br />combined with the existing property and structures owned by the Watershed <br />District. <br />6. The applicant shall demonstrate by clear and convincing evidence that the <br />development of the conditional use shall reflect the architectural character of the <br />conforming buildings in the surrounding area in regard to the following: <br />a. Proportion, scale and roof line; <br />b. Architectural style; and <br />c. Exterior finish materials. <br />Comment: Not applicable. No new building will be constructed as a result of the <br />requested zoning amendment. <br />Conditional Use Permit <br />The Zoning Ordinance does not limit the construction of accessory buildings on Public <br />zoned lands, except that as noted, such buildings would require approval of a <br />Conditional Use Permit, which is presently addressed. <br />According to the Zoning Ordinance, other local and regional government buildings are <br />allowed as a conditional use in the Public District provided that: <br />1. The use meets all zoning regulations, including environmental zoning <br />standards. <br />Comment: The garage appears to meet setback requirements. In finalizing <br />the site, landscaping, and stormwater plans, the applicants will have to verify <br />that the garage is not located within a public drainage, utility or access <br />easement. <br />2. No outdoor storage of materials, equipment, or trucks is permitted. <br />Comment: All materials and equipment will have to be stored within the <br />garage. <br />3. All parking areas are screened from view of adjoining residential zoning <br />districts. <br />7 <br />
