PITRINA PARK - DEVELOPMENT AGREEMENT <br />Developer's failure to complete the project. <br />12. Grading and Drainage Plans. The Developer shall complete a <br />drainage and grading study as required for subdivision approval and furnish <br />said study to the City Engineer. Said study must be approved by the <br />Ramsey - Washington Watershed District including the completion of the <br />Municipal Coordination Checklist. It is also understood that erosion <br />control must be such that drainage to adjacent property is prevented and <br />surface water run -off is properly controlled. The Developer agrees to <br />comply with any and all requirements for erosion control directed by the <br />Ramsey - Washington Watershed District and /or the City in a timely manner. <br />13. Park Dedication Requirements. <br />a. It is understood that park dedication fees pursuant to City <br />ordinance will be payable at the time of building permit application. No <br />building permit will be issued until this fee is paid. <br />b. Developer shall install a six -foot wide, paved pathway on a <br />twelve foot easement located between Lots 34 and 35 of Block 1 which will <br />connect the street to the nearest existing Pioneer Park trail. At the <br />access to each end of the path within the development, Developer shall <br />erect a low split rail fence to delineate this area. Construction of trail <br />and fencing is to be done to City standards and with approval of the Public <br />Works Director. <br />14. Building Permit for Model Units. The City will issue two (2) <br />building permits to Developer to allow construction of four (4) model units <br />on lots within the Pitrina Park Terrace Development after receipt of the <br />Letter of Credit, required in Paragraph #16. No occupancy permit will be <br />granted until installation and approval by the City of utilities, curb and <br />gutter, and the first lift of bituminous surface. The Developer agrees to <br />make any corrections to the improvements deemed necessary by the City <br />Engineer resulting from construction of the model units.
