Fahey <br />COUNCIL <br />Beverly Scalze <br />Jim LaValle <br />Steve Morelan <br />Bob Pedersen <br />ADMINISIRATOR <br />Joel R Hanson <br />Attached is a revised Final Plat for Pitrina Park Terrace Second Addition. Please note that the <br />cul -de -sacs within this plat are designated as outlots, thus making them private streets which will <br />be owned and maintained by the homeowners association. Also note that the walkway easement <br />from one of the cul -de -sacs to Pioneer Park is 12 feet in width as was stipulated in the <br />development agreement for this project. <br />With regard to the cul -de -sacs in Pitrina Park Terrace First Addition which were platted as public <br />streets, it is staff's recommendation that the Council call for a vacation hearing to vacate the <br />public's interest in the street right -of -way. All necessary drainage and utility easements will be <br />maintained. Attached is a resolution which would call for a vacation hearing to be held on <br />Wednesday, August 12, 1998. <br />The issue of public versus private streets was discussed with Gordie Howe, Masterpiece Homes, <br />and he concurs that it was always the intention to retain the cul -de -sacs as private streets. The <br />homeowners abutting these streets were informed that the cul -de -sacs were private at the time <br />they purchased their homes. Gordie will be bringing in a petition signed by the property owners <br />which states their understanding that the cul -de -sacs were dedicated as public and as a result of <br />the vacation, will become private. <br />We will also be obtaining an easement (as a separate document) from Frank Frattalone over <br />Outlot B. This will allow that area to be used as a waling path by the public to connect the 12- <br />foot trail easement to Allen Avenue. This document should be available at Wednesday's <br />meeting. <br />Lastly, there is no looping of utility lines.
