HF2920 FIRST ENGROSSMENT [REVISOR ) MS H2920 -1 <br />1 be 51 percent completed within two years of the date of board <br />2 approval. "Fifty -one percent completed" means that the work <br />3 completed must represent at least 51 percent of the value of the <br />4 project as documented by the contractor or vendor. An <br />5 organization that fails to comply with this paragraph shall <br />6 reapply to the board for approval of the project. <br />7 Sec. 6. Minnesota Statutes 1996, section 349.213, <br />8 subdivision 1, is amended to read: <br />9 Subdivision 1. [LOCAL REGULATION.) (a) A statutory or home <br />10 rule city or county has the authority to adopt more stringent <br />11 regulation of lawful gambling within its jurisdiction, including <br />12 the prohibition of lawful gambling, and may require a permit for <br />13 the conduct of gambling exempt from licensing under section <br />14 349.166. The fee for a permit issued under this subdivision may <br />15 not exceed $100. The authority granted by this subdivision does <br />16 not include the authority to require a license or permit to <br />17 conduct gambling by organizations or sales by distributors <br />18 licensed by the board. The authority granted by this <br />19 subdivision does not include the authority to require an <br />20 organization to make specific expenditures of more than ten <br />21 percent from its net profits derived from lawful gambling. For <br />22 the purposes of this subdivision, net profits are gross profits <br />23 less amounts expended for allowable expenses and paid in taxes <br />24 assessed on lawful gambling. A statutory or home rule charter <br />25 city or a county may not require an organization conducting <br />26 lawful gambling within its jurisdiction to make an expenditure <br />27 to the city or county as a condition to operate within that city <br />28 or county, except as authorized under section 349.16, <br />29 subdivision 8, or 297E.02; provided, however, that an ordinance <br />30 requirement that such organizations must contribute ten percent <br />31 of their net profits derived from lawful gambling conducted at <br />32 premises within the city's or county's jurisdiction to a fund <br />33 administered and regulated by the responsible local unit of <br />34 government without cost to such fund, for disbursement by the <br />35 responsible local unit of government of the receipts for (i) <br />36 lawful purposes, or (ii) police, fire, and other emergency or <br />Section 6 <br />Page 103 <br />
