problematic given the question of frontage discussed above. Regardless of how <br />frontage is determined however, the rear lot will have sufficient width. <br />► Setbacks. In order to provide for a consistent development pattern within the area, <br />the City may wish to consider the two lots along Rice Street as corner lots with <br />appropriate side yard setbacks of 40 feet from the private street. The Tuffy's Auto <br />Center site has been designed with a 20 foot setback. The City may allow for the <br />20 foot setback as part of the PUD if so inclined, however, it should be noted that <br />the rear lot is illustrated with a 40 foot setback from the private street. <br />► Preliminary / final plat. The applicant has not submitted a preliminary plat in <br />accordance with the provisions of the City's Subdivision Ordinance. This <br />information will be required as a condition df approval should the City approve the <br />proposed PUD Concept Plan. <br />• Park dedication. The Parks and Recreation Committee will recommend the <br />amount of a cash contribution in lieu of a land donation per Section 1007.040 of the <br />Subdivision Ordinance. Payment of all park contributions will be paid at the time of <br />development contract approval. <br />Grading, drainage and utility issues. The applicant has indicated grading, <br />drainage and utility elements of the proposed subdivision of the submitted site plan. <br />These elements shall be subject to review and approval of the City Engineer. <br />• Development agreement. The applicant shall be required to enter into a <br />development agreement with the City as a condition of approval, subject to review <br />and approval of the City Attorney. <br />Conditional Use Permit for auto repair minor use. As noted above, the applicant is <br />seeking development plan approval for a auto repair -minor use on the proposed northwest <br />lot of the subdivision. Should the City Council deny the applicant's rezoning request, <br />consideration of this request is moot as auto repair -minor is not a permitted or conditional <br />use within the 6 -3 District. Auto repair -minor is a conditional use within the B -2 District as <br />outlined in Section 911.040.0 of the Zoning Ordinance. As such, consideration should be <br />given to the following factors: <br />• Conditional Use Permit. Section 921.010 (C) of the Zoning Ordinance requires <br />the City to consider the possible adverse effects of the proposed Planned Unit <br />Development.
