MnDOT Contract No. 1062987 <br /> <br /> <br />2 <br />2. Local Government’s Duties <br />2.1. The Local Government will perform all of its duties and obligations in MnDOT Contract Number 1052070, <br />which is incorporated herein by reference, in the solicitation, letting, award, and administration of the <br />construction of the Project. <br />3. MnDOT’s Duties <br />3.1. MnDOT will perform all of its duties in accordance with MnDOT Contract Number 1052070, which is <br />incorporated herein by reference. <br />3.2. MnDOT will make the necessary requests to the FHWA for authorization to use federal funds for the Project, <br />and for reimbursement of eligible costs pursuant to the terms of this Agreement. <br />3.3. MnDOT will request the conversion of the Project to federal funding of eligible costs, when funding and <br />obligation authority are available. <br />3.4. At such time that the project is converted to federal funding and such funding is received by MnDOT, <br />MnDOT will reimburse to the Local Government the federal aid share of the federally eligible costs, <br />previously provided by the Local Government. Reimbursement for Local Government State Aid funds used in <br />lieu of federal funds, will be deposited in the Local Government‘s State Aid Account. Reimbursement for <br />other Local Government funds used in lieu of federal funds will be forwarded to the Local Government. <br />4. Time <br />4.1. The Local Government must comply with all the time requirements described in this Agreement. In the <br />performance of this Agreement, time is of the essence <br />4.2. The period of performance is defined as beginning on the date of federal authorization and ending on the <br />date defined in the federal financial system or federal agreement (“end date”). No work completed after <br />the end date will be eligible for federal funding. Local Government must submit all contract close out <br />paperwork to MnDOT, at least twenty-four months prior to the end date. <br />5. Payment <br />5.1. It is estimated that the total cost of the Project is $9,359,000 and that the anticipated federal funding will be <br />$6,296,500. The remaining share will be paid by the Local Government. The Local Government will pay any <br />part of the cost or expense of the work that the FHWA does not pay. <br />5.2. The Local Government will request reimbursement of the federal aid share of the federally eligible costs <br />after funding and obligation authority are available. <br />5.3. If the project is converted to federal funding before completion and final acceptance, the Local Government <br />will make requests for reimbursement as partial estimates and will comply with the payment provisions in <br />MnDOT Contract Number 1052070 which is incorporated by reference, and 2 CFR Part 200. <br />6.
