Access to and egress from the Project Facilities and all improvements to be constructed thereon are <br />in accordance with all applicable Legal Requirements. Water, drainage and sanitary sewerage <br />facilities and telephone, gas and electric services of public utilities are or are due to be installed in <br />the locations indicated on the Plans and Specifications and are adequate to serve the Project <br />Facilities. All necessary approvals for installation of or connection to said facilities or services <br />have been obtained. <br />7. To the best of our knowledge, there are no petitions, actions or proceedings pending or threatened <br />to revoke, rescind, alter or declare invalid any laws, ordinances, regulations, permits, licenses or <br />approvals for or relating to the Project Facilities. <br />8. No amendments, modifications or changes have been made to our contract dated ___________, <br />20__ with the Borrower except such as have had your prior written approval. <br />9. The Borrower is not in default of any of the Borrower’s obligations to us as of the date hereof <br />except as follows: <br />This certificate is rendered based on our examination of the Project Facilities, the Plans and <br />Specifications, the data comprising the Application for Payment and all other matters which we deem <br />relevant. We are to incur no liability under this certificate except for failure to exercise due professional <br />skill and diligence.
