Mortgagee Clause (applies to R4CF debt only): <br />For Debt - All property and casualty insurance policies shall contain a standard non- <br />contributory mortgagee clause showing the interest of the Trustee as first mortgagee and shall <br />provide for payment to the Trustee of the net proceeds of insurance resulting from any claim for <br />loss or damage thereunder. <br />9. R4 reserves the right to amend these requirements at any time as deemed appropriate. <br />10. R4 may require: <br />a. For Equity – Additional coverages or higher limits of insurance or against other hazards <br />for which insurance is reasonably obtainable and which, at the time, are commonly <br />insured against in the case of similar properties conducting similar activities within the <br />geographic area of the Property, whether such additional insurance requirements are <br />otherwise described or contemplated herein. <br />b. For Debt - additional insurance coverages to meet Freddie Mac Multifamily Insurance <br />Requirements whether such additional insurance requirements are otherwise described <br />or contemplated herein. If, at any time, R4 is not in receipt of written evidence <br />satisfactory to R4 that all insurance policies are in full force and effect, within fourteen <br />(14) days after R4 has requested same or if the Partnership fails to maintain the <br />insurance required hereunder, after notice is given to the Partnership, R4 shall have the <br />right, but shall not be obligated, to take such action as R4 deems necessary to protect <br />their interest in the Property, including the obtaining of such insurance coverage as R4 <br />in its reasonable discretion deems appropriate. All premiums incurred by R4 in <br />connection with such action or in obtaining such insurance and keeping it in effect shall <br />be paid by the Partnership to R4 within ten (10) days of demand. <br />11. For Debt – all the Permanent Phase Partnership insurance requirements are intended to <br />meet the minimums of Freddie Mac Multifamily Insurance Requirements including <br />coverage for any “special hazards” (i.e., swimming pools, garages, exercise rooms, <br />restaurants, drug stores, etc.). <br /> <br /> <br />Balance of this page left blank intentionally.
