Unknown document property name. <br />(b) A total project cost statement sworn to by the Borrower to be a true, complete and accurate <br />account of all costs actually incurred and a reasonable estimate of costs to be incurred for <br />the Project. <br />(c) One copy of the Construction Plans. <br />(d) One copy of a recent survey of the Land prepared by a registered land surveyor dated within <br />120 days of the Date of Closing describing and showing the Land and the location of the <br />Improvements thereon, disclosing easements (both appurtenant and encumbrances upon <br />the Land, giving appropriate ownership and recording data), encroachments, if any, and <br />disclosing all unsatisfactory survey conditions, if any (the “Survey”). The Survey shall bear <br />a proper surveyor’s certificate, including the legal description of the Land, the legal <br />description of all easements both appurtenant and encumbrances and shall state that the <br />survey and certificate run to the benefit of Lender and Title. The Survey shall specifically <br />show the following matters to the extent possible at the time of the Survey: <br />(i) dimensions and total square footage area of the Land surveyed with acreage <br />designation to three decimal points; and <br />(ii) the location and names of adjoining public roads and streets. <br /> <br />(e) Copies of the Other Project Financing Documents, any subordination agreements between <br />Lender and any holder of any Project Financing, the master disbursement agreement, and <br />the documents providing for all additional funds necessary to pay all Construction Costs. <br /> <br />(f) Borrower’s organizational documents, including all relevant partnership agreements, <br />articles of incorporation, bylaws, authorizing resolutions, certificates of good standing, and <br />501(c)(3) certifications. <br />“Construction Costs” shall mean all costs paid to complete construction of the Project <br />Improvements, including, but not limited to, site preparation costs, architectural fees, engineering fees, <br />surveying charges, contractor fees, bond fees, insurance costs, legal fees, and all costs of labor, material <br />and services paid or incurred by Borrower, as shown on a sworn construction cost statement approved by <br />Lender. <br />“Construction Plans” shall mean the written plans and specifications for the Project, which shall be <br />approved in writing by the Lender prior to the advances disbursed pursuant to Article 3 and which are <br />hereby made a part hereof, along with other drawings and related documents on the construction work to <br />be performed by Borrower or its contractor on the Premises, which (a) shall be as detailed as the plans, <br />specifications, drawings and related documents which are submitted to the building inspector of the City; <br />and (b) shall include at least the following: (1) site plan; (2) basement plans, if applicable; (3) floor plan for <br />each floor; (4) landscape plan; and (5) signage as described in Section 7.09. Borrower agrees that all work <br />items within the plans and specifications pertaining to mechanical, electrical or structural work shall have <br />been reviewed, approved and/or certified by the appropriate licensed or registered professional engineer or <br />architect as required by law and necessary to ensure health and safety.
