All other provisions of the <br />Retainer Agreement as approved, and as subsequently amended, <br />remain in effect. <br />(A) Civil legal services covered by retainer. <br />The services included in the retainer are the attorney's <br />reports, agenda reports, non - appellate research, ordinance <br />drafting, review of customary contracts and leases, <br />consultations with the administrative staff, City Council, <br />and other City employees, legal opinions, attendance at two <br />Council meetings per month, and the ordinary and usual day <br />to day City legal work. For these services the Attorneys <br />shall be paid a retainer fee of $2,175.00 per month. <br />(C) Services not included in the retainer. <br />The monthly retainers do not include legal services in <br />connection with civil litigation, gross misdemeanor and <br />appellate criminal work, attendance in downtown St. Paul at <br />the morning custody arraignments, improvement projects, <br />development projects, condemnations, real estate purchases <br />and sales, emergency or special projects, routine clerical <br />matters, resolutions, investigation or negotiations. These <br />services described in this Paragraph will be billed hourly <br />at $92.50 per hour for attorneys and $45.00 per hour for <br />paralegals. <br />This Amendment shall be effective January 1, 1998. <br />Page 17 <br />
