UNDERGROUND INSTALLATION OF NEW UTILITY LINES <br />2301.010. PURPOSE. This Ordinance is enacted to provide for <br />orderly, economic and safe development of land and urban services <br />and facilities, and to promote the public health, safety and <br />general welfare of the inhabitants of the City of Little Canada. <br />2301.020. UNDERGROUND INSTALLATION OF NEW UTILITY LINES. All <br />new electric distribution lines (excluding main line feeders and <br />high voltage transmission lines), CATV lines, telephone service <br />lines and other services constructed and providing service to <br />customers shall be buried underground. These regulations shall <br />apply to all new land development proposals in the City including, <br />but not limited to, new subdivision, apartments, non - residential <br />buildings, planned unit developments, and single family dwellings. <br />The developer is responsible for complying with these <br />regulations and shall submit with his application for final plat or <br />site plan approval, a written statement from the utility companies <br />that the necessary arrangements for the underground installation of <br />utilities have been made and associated easements incorporated into <br />the plat. <br />It shall be the responsibility of the developer and all <br />contractors involved in construction to establish and maintain <br />grade within utility easements to within six (6) inches of final <br />grade and to keep utility easements free and clear, to the end that <br />the utility company shall have access at all times for installation <br />and maintenance of its utilities. <br />This Ordinance applies to public utility lines designed and <br />constructed to distribute utility services to customers in the <br />City, but does not require underground installation. of appurtenant <br />facilities such as lift stations, fire hydrants, meters, <br />transformers, pedestals, and the like. <br />2301.030. EXCAVATION. In the interest of public safety and <br />to avoid possible damage to underground utilities, no person, firm <br />or corporate body shall excavate in any easement or right -of -way <br />containing underground utilities without first notifying the <br />utility company, or companies, whose lines occupy the easement or <br />right -of -way; provided however such excavation shall not constitute <br />a breach of this Ordinance unless the excavator has actual notice <br />2301 -1 <br />Page 49 <br />
