3 <br /> <br /> <br />Retail <br />The proposed amendment to Chapter 905 – Commercial Districts and Chapter 906 – Industrial <br />Districts, would allow Cannabis retail as a conditional use to occur in the following zoning districts <br />1. C-1 – General Commercial <br />2. C-2 – Corridor Mixed <br />3. I-1 – Limited Industrial <br />The state has three different types of cannabis businesses that can be endorsed for retail. There are <br />additional caveats to how many locations they can operate within the State with each classification <br />which can be viewed in the OCM guide (Attachment 8) <br />1. Retailer – A business that is selling cannabis products produced by another firm. <br />2. Microbusiness – A business that is selling cannabis products that they’ve personally produced <br />in a small facility. The production and manufacturing of cannabis does not have to occur on the <br />same site that they’re selling the goods (e.g. the growing and processing could occur in Wadena <br />and the retail sale of it could be exclusively in Little Canada). <br />3. Mezzobusiness – Essentially, a larger version of a microbusiness. <br /> <br />Staff have proposed an additional caveat that the retail sale of cannabis cannot be co-located with any <br />residences. Without this stipulation, if allowed in the C-2 – Corridor Mixed zoning district, a cannabis <br />seller could potentially be located in the <br /> <br />Non-Retail Activities <br />The proposed amendment to Chapter 906 – Industrial Districts, would allow all other types of <br />Cannabis uses (cultivation, manufacturing, wholesaler, etc.) to occur as a conditional use in the <br />following zoning districts <br /> <br />1. I-1 – Limited Industrial <br /> <br />The I-1 District is where the city’s older industrial facilities are and is generally a further distance from <br />residential users than the I-2 zoned properties. The proposed ordinance has added an additional <br />requirement that no such use can be adjacent to a residentially-zoned property or nonconforming <br />residential use. <br /> <br />Conditional Use <br />The proposed ordinance has all types of cannabis uses allowed as conditional uses. This provides the <br />City a slightly higher-level of discretion on specific locations however, most applicants will likely <br />meet the standards to be approved. The benefit of making cannabis a conditional use is not necessarily <br />in having discretion to “choose” an applicant but in the ability to hold nuisance businesses accountable. <br />The City Council expressed a preference at their 10/10/2024 work meeting to make them conditional <br />uses. <br /> <br />The City is free to allow cannabis uses as general permitted uses. If the Planning Commission has a <br />strong difference of opinion, they should provide that feedback. <br /> <br />Buffers <br />At their work meeting, the City Council was supportive of 500’ buffers from all State-permitted places: <br />1.
