MINUTES <br />PLANNING COMMISSION <br />FEBRUARY 8, 2007 <br />Duray recommended approval of the Conditional Use Perrnit for the <br />operation of a convenience store/motor fuel station in the B-4 District at <br />228 Little Canada Road, Sinclair Station, subject to compliance with <br />conditions #1 through #18 as outlined on pages 2 and 3 of the City <br />Planner's February 2, 2007 report at the time that future upgrades of this <br />site occur, subject to the Little Canada Road pylon sign being brought into <br />compliance with the City's sign regulations at this time, and allowing the <br />high rise freeway sign face to be changed to meet the City's Architectural <br />Guidelines. <br />Motion seconded by Helmeke. <br />Motion carried 5 - 0. <br />- The Commission considered the application for Planned Unit <br />Development Permit to allow for an interim use of commercial property <br />at 2968 Rice Street for a private auto repair hobbyist submitted by <br />Marilyn Montreux on behalf of Ann Trobec. <br />Marilyn Montreux reported that the back buildings on the property at 2968 <br />Rice Street have been rented for the past seven years to Henry Anderson. <br />Mr. Anderson uses these buildings for his hobby, which is working on his <br />race cars. Montreux reported that there are no bathroom facilities in these <br />back buildings, and has learned from the City that this rental use does not <br />comply with the Code. Montreux suggested that a solution would be to <br />allow Mr. Anderson the use of the bathroom facilities in the house on the <br />property. The house is vacant, but in good repair. <br />The City Planner explained the location of the property noting it is a long, <br />narrow parcel. The property was a former residence, but the owner has <br />moved out of the house. The back buildings on the property have been <br />rented for a number of years, and the applicant is asking that the rental use <br />can remain on the site until the property is sold. <br />The Planner noted that the property has a commercial Planned Unit <br />Development zoning. There have been some enforcement actions at this <br />property given that anauto-related business is not allowed under PUD. As <br />a result of these actions, the applicant is requesting the interim use of the <br />property by the auto repair hobbyist until the property can be sold. The <br />Planner noted that the applicant is also asking for outdoor storage at the rear <br />of the property. <br />- E¢~ <br />
