MINUTES <br />PLANNING COMMISSION <br />APRIL 10, 2008 <br />require a CUP. The Administrator noted that the Deeb storage might not <br />have been legally established. If so, it is not grandfathered in. The <br />Administrator also pointed out that some trailers used for storage may be <br />rusted or in bad shape, resulting in the City getting complaints. The <br />Administrator noted that there may be only slight differences between <br />trailer storage and storage containers, however, in all cases Conditional Use <br />Permits are necessary for this storage. <br />Knudsen asked for an explanation about outdoor storage being an accessory <br />use. The City Planner reviewed that section of the Code, noting the <br />requirement that the storage must be "incidental to the principal use". <br />Knudsen stated that he did not want to see the situation where property <br />owners could brokerage outdoor storage space to anyone who wants it. He <br />indicated, however, that he did not have a concern with leasing outdoor <br />storage to a Little Canada business that needs the space. However, both <br />properties would have to be code compliant. <br />The City Planner suggested that to accommodate this, a Code provision <br />would have to be crafted that allowed for off-site outdoor storage. The <br />Planner suggested that this provision would include standards relative to <br />distance separation between properties, a limitation to I-1 properties, etc. <br />Knudsen again stated that both properties would have to be Code <br />compliance. The Planner also recommended that the properties should still <br />be subject to the 60% rule and the outdoor storage would have to be <br />licensed. Knudsen stated that the intention would be to accommodate <br />businesses within the City and allow businesses to help their neighbors. <br />Pechmann again expressed concern about the relationship between the two <br />businesses deteriorating over time, and the City then having to address off- <br />site outdoor storage problems on a property. The Planner again noted that <br />the outdoor storage would be regulated by CUP as well as an annual <br />license. If there is a problem, the City could cite the property owner as well <br />as revoke the CUP and license. <br />Rossow indicated that it would be his understanding that if he leases <br />outdoor storage space on his property, he, as the property owner, would be <br />responsible for that storage. Rossow indicated that he scrutinizes <br />businesses wanting to rent his property so he can try to prevent a problem <br />down the road. <br />Knudsen suggested that perhaps the off-site outdoor storage should be <br />limited to one tenant per property. Rossow noted that he has a large <br />property with a small building, therefore, quite a bit of available outdoor <br />storage space. Rossow stated that he would like some latitude to take <br />advantage of an off-site outdoor storage provision. <br />-10- <br />
