Hanson <br />TO: Mayor Fahey and Members of the City Council <br />FROM: Kathy Glanzer, Administrative Assistant <br />RE: Building Permit, Setback Requirements, and Placement <br />for Sheds up to 120 Square Feet in Size <br />Attached is a summary of building permit, setback, and placement <br />issues related to sheds up to 120 square feet in size. Some of <br />this information was provided to you earlier, while other <br />information is new. I have combined all of it on the attached <br />spreadsheet for your convenience. <br />Based on the attached information, it would be staff's <br />recommendation that sheds up to 120 square feet in size be <br />exempted from building permit requirements. (This is consistent <br />with the Building Code and had been past practice.) <br />Staff also recommends 3 -foot minimum setbacks from the side and <br />rear property lines. The rational for the 3 -foot minimum setback <br />is to allow for maintenance and mowing around the shed without <br />trespassing onto adjacent property, as well as the fact that the <br />City has a number of sheds in violation of our 10 -foot minimum <br />setback requirement for accessory structures. It is felt the a- <br />foot minimum would eliminate many of the existing violations. <br />If there is concern about the placement of sheds adjacent to a <br />structure, another option for the Council to consider would be <br />limiting sheds to rear yards only. <br />Also recommended is that we clarify that sheds may not be set in <br />front of a structure (within the area between right -of -way and <br />structure), and that sheds be at least six feet from the <br />principle structure (pursuant to UBC). <br />Please note that these recommendations apply to sheds up to 120 <br />square feet in size. Existing Code requirements would apply to <br />accessory structures greater than 120 square feet. Therefore, it <br />may be necessary to define "Accessory Shed" for purposes of the <br />Code, and clarify the definition of "Accessory Building ". <br />Suggested definitions are as follows: <br />Page 17 <br />
