515 Little Canada Road, Little Canada, MN 55117-1600
(612) 484 -2177 / FAX: (612) 484 -4538
MEMORANDUM
MAYOR
Michael I. Fahey
COUNCIL
Beverly Scalze
Jim LaValle
Steve Morelan
Bob Pedersen
ADMINISTRATOR
Joel R. Hanson
TO: Mayor Fahey & Members of the City Council
FROM: Joel Hanson, City Administrator
DATE: February 7, 1997
RE: Revisions to Ordinance Regulating Surface Water Usage on Lake Gervais
Mugs Nardini and Mark Weavers representing the Gervais Lake Association have proposed
revisions to our surface water management ordinance. As you recall, this issue was initially
raised by the Sheriff's Department approximately two years ago. At that time, the Sheriff's
Department determined that other provisions of our ordinance would allow them to address
their issues of concern. However, the Lake Association has continued to study the matter in
order to address the needs of the property owners in the area.
The attached draft was prepared by the Association and presented to us for consideration. It
has been reviewed by staff at the Minnesota Department of Natural Resources and their
comments have been incorporated. I have forwarded the draft on to the City Attorney and he
indicated it is acceptable to him subject to any policy discussions the Council may have. The
Association is also conducting the same process with the City of Maplewood as it is
necessary that both cities adopt identical ordinances.
Ms. Nardini and Mr. Weavers will be present at Wednesday's meeting to ask the Council to
consider the adoption of this ordinance. (Changes noted in attached correspondence.) The
Council should decide on a process to do so if you are so inclined.
JRH:kpv
Enclosure
cc: Mugs Nardini
Mark Weavers
Page 2
