515 Little Canada Road, Little Canada, MN 55117-1600
(612) 484 -2177 / FAX: (612) 484 -4538
December 13, 1996
TO: Mayor Fahey and Members of the City Council
FROM: Kathy Glanzer, Administrative Assistant
RE: Vacation of Portion of East Rose Place
MAYOR
Michael I. Fahey
COUNCIL
Beverly Scalze
Jim LaValle
Steve Morel=
Bob Pedersen
ADMINISTRATOR
Joel R. Hanson
As you may recall, the Engebretson property located on Old County
Road C was subdivided a couple of years ago. In selling the
subdivided lot, Stewart Title identified an error in the legal
description for the portion of East Rose Place which was
dedicated by Mr. and Mrs. Engebretson in 1974. The error would
place East Rose Place through the Engebretson home.
To remedy the situation, the incorrectly described portion of
East Rose Place will need to be vacated. In conjunction with
this action, the City Attorney is drafting new easement documents
to address the actual location of the street.
Therefore, it is staff's recommendation that Council call for a
hearing to consider the vacation of East Rose Place as
incorrectly described in the easement documents granted to the
City in 1974.
Page 3
