Section 903.020.D.2. is hereby amended to read as follows: <br />D. 2. a. Except for farm buildings and accessory sheds, no <br />accessory buidlings, structures, uses and equipment <br />shall be erected or located within any required <br />yard other than a rear yard. Accessory sheds may <br />be located in the side yard, provided that such <br />shed is located no closer than three (3) feet to <br />any side or rear lot line. In no case shall an <br />accessory shed be located within thirty (30) feet <br />of a public right of way. <br />b. Except by Conditional Use Permit, no accessory <br />building or shed may be located closer to the front <br />line of the lot than the rear building line of the <br />principal structure. The issuance of a Conditional <br />Use Permit for location in front of the rear <br />building line of the principal structure shall be <br />conditioned upon factors including, but not limited <br />to, the following: <br />i. There is additional width of the lot which <br />justifies placing the accessory building in <br />the side yard. <br />ii. The architectural appearance of the accessory <br />building is coordinated with the principal <br />structure. <br />iii. The accessory building complies with all other <br />provisions of this section. <br />iv. The provisions of Section 921 of the Zoning <br />Ordinance are considered and met. <br />Section 5. <br />Section 903.020.D.3. is hereby amended by adding the following: <br />D. 3. Except for farm and agricultural buildings, accessory <br />buildings in residential zoning districts shall not <br />exceed fifteen (15) feet in height, shall not be closer <br />than six (6) feet to any other building or structure on <br />the same lot, and shall not be located within a public <br />drainage, utility or access easement. Subject to other <br />provisions as contained in this section, accessory <br />buildings, uses and equipment may encroach into the <br />required rear yard, but in no case shall an accessory <br />building, use or equipment be located closer than ten <br />(10) feet to a rear yard or side yard lot line except as <br />may be modified within a specific use district. <br />Accessory sheds may be located in required rear yards, <br />but in no case shall such sheds be located closer than <br />three (3) feet to a rear lot line. <br />Page 2 <br />
