RESOLUTION FOR VACATING ROAD RIGHT -OF -WAY <br />WHEREAS, <br />The City Council of Little Canada has determined to vacate the <br />following road right -of -way: <br />That part of Minnesota Avenue as dedicated on the plat of <br />J.F. Eisenmenger's Garden Lots, according to the recorded <br />plat thereof on file and of record in the office of the <br />County Recorder in and for Ramsey County, Minnesota, lying <br />easterly of the northerly extension of the west line of Lot <br />42, said J.F. Eisenmenger's Garden Lots and lying westerly <br />of a line drawn 60.00 feet northwesterly of and parallel <br />with a line described as commencing at the southeast corner <br />of Tract C, REGISTERED LAND SURVEY NO. 300, files of the <br />Registrar of Titles, Ramsey County, Minnesota; thence on an <br />assumed bearing of South 0 degrees 23 minutes 07 seconds <br />East along the southerly extension of the east line of said <br />Tract C a distance of 16.05 feet to the point of beginning <br />of the line to be described; thence South 51 degrees 48 <br />minutes 46 seconds West a distance of 426.02 feet and said <br />line there terminating. <br />AND WHEREAS, <br />A public hearing was held on the 12th day of March, 1997 before <br />the City Council in the City Hall after due published and posted <br />notice had been given by the City Administrator, a reasonable <br />attempt was made to give personal notice to all affected property <br />owners, and all persons interested were given an opportunity to <br />be heard; <br />AND WHEREAS, <br />Any person, corporation or city owning or controlling easements <br />contained upon the property vacated, reserves the right to <br />continue maintaining the same or to enter upon such way or <br />portion thereof vacated to maintain, repair, replace, remove or <br />otherwise attend thereto; <br />AND WHEREAS, <br />It appears that it will be in the best interest of the city to <br />vacate such road right -of -way easement; <br />AND WHEREAS, <br />Four- fifths of all members of the City Council concur in this <br />Page 22 <br />
