RESOLUTION FOR VACATING ROAD RIGHT -OF -WAY WHEREAS, The City Council of Little Canada has determined to vacate the following road right -of -way: That part of Minnesota Avenue as dedicated on the plat of J.F. Eisenmenger's Garden Lots, according to the recorded plat thereof on file and of record in the office of the County Recorder in and for Ramsey County, Minnesota, lying easterly of the northerly extension of the west line of Lot 42, said J.F. Eisenmenger's Garden Lots and lying westerly of a line drawn 60.00 feet northwesterly of and parallel with a line described as commencing at the southeast corner of Tract C, REGISTERED LAND SURVEY NO. 300, files of the Registrar of Titles, Ramsey County, Minnesota; thence on an assumed bearing of South 0 degrees 23 minutes 07 seconds East along the southerly extension of the east line of said Tract C a distance of 16.05 feet to the point of beginning of the line to be described; thence South 51 degrees 48 minutes 46 seconds West a distance of 426.02 feet and said line there terminating. AND WHEREAS, A public hearing was held on the 12th day of March, 1997 before the City Council in the City Hall after due published and posted notice had been given by the City Administrator, a reasonable attempt was made to give personal notice to all affected property owners, and all persons interested were given an opportunity to be heard; AND WHEREAS, Any person, corporation or city owning or controlling easements contained upon the property vacated, reserves the right to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove or otherwise attend thereto; AND WHEREAS, It appears that it will be in the best interest of the city to vacate such road right -of -way easement; AND WHEREAS, Four- fifths of all members of the City Council concur in this Page 22
